Court Rejects Same-Sex Marriage Ban in California

We haven't won yet -- the judge ("Vaughn R. Walker, the chief judge of the Federal District Court in San Francisco, who heard the case without a jury") immediately placed a stay on his own ruling, pending appeals, and the NYT says it "seems all but certain to be settled by the Supreme Court."

Still. Chip away, chip away at the stone.

Time for me to weigh in with my trademark pessimism: This is a great day for people who care about human values and not deranged sociopathy, for sure. And today's victory will help fortify our spirit and resolve to keep going for the long battle against ultraconservative extremism that lies ahead. But today's ruling is almost certain (in my pessimistic opinion) to be overturned by the Roberts court. I guess it all depends on Kennedy. And I guess I can see the possibility that Kennedy will rule to uphold, but who knows.

And while I'm predicting the future, I'll also go on the record and predict that the Roberts Court will gut the Affordable Care Act. I think the conservative gang on the Court is just itching to reign in the liberal interpretation of the Commerce Clause, and the Affordable Care Act may be an opportunity for them to start down that path.

I will admit I know nothing about law and should refrain from offering opinions about things I know so little. But you know, it costs nothing to flap one's jaw. ;-)

Are you the kind of person who always predicts the worst possible outcome, so that if it happens you're prepared? And if the good outcome turns out to be the one, then, you are very pleasantly surprised?
